Welcome to NeighborPlay Toy Exchange! We're so glad you're here. This Subscriber Agreement outlines the terms and conditions of our toy subscription service. Please read it carefully before subscribing.
1. Subscription Overview
By subscribing, you agree to receive a rotating set of toys on a recurring basis as selected through your subscription plan. Our standard plans offer 3 or 5 toys per month, with the option to upgrade or downgrade based on availability.
2. Toy Selection
Toys can be selected from our online catalog based on your child’s age and interests. You must complete your toy selections at least 24 hours prior to your scheduled delivery/swap date. Because we personally deliver and pick up your toys in one trip, we’re unable to complete your swap unless your toy selections are made on time. If toy choices aren’t submitted by the 24-hour deadline, we’ll need to delay your swap and late fees will apply based on your current toys not being returned on schedule. If toys are not returned by your scheduled swap date, a late fee of $1 per day, per toy or set will apply. Late fees are capped at $50 per swap cycle to keep things fair. 24 hours is needed to process your order and deliver toys, if toy selections are not made until the day of your scheduled swap, you will be charged the $1 per toy late fee for 1 day as the toys will not be able to be delivered until 1 day past your swap date. **To avoid a late fee drop off your current toys to us on or before your swap date if you’re still finalizing new selections. Toys may be "renewed" if there is no hold on your current toy selection.
3. Delivery & Pickup
We offer local delivery and pickup options. You will receive a confirmation email or text the day before your scheduled toy swap. Toys must be ready for pickup at the arranged time and location. Please place all toys in the provided return container or bag. We currently offer local delivery options to make toy swapping even easier. You can choose porch drop-off or meet us at the local library.
4. Returns & Toy Condition Expectations
We understand that kids play hard—that’s the point! Normal wear and tear is expected. However, subscribers are expected to:
Return all toy pieces and packaging provided
Clean toys with a damp cloth before return
Notify us of any damage or missing parts
5. Missing or Damaged Items
If toys are returned with significant damage beyond normal use or with missing components, the following may apply:
Minor damage or single missing piece: no charge
Major damage or missing item that renders toy unusable: replacement fee (up to retail value)
Persistent or repeated issues may result in a suspension of service
6. Porch Deliveries & Responsibility
For customers who choose porch delivery, your toys will be left at the designated drop-off location you provide. A photo will be taken and sent to confirm delivery. Once delivery is confirmed and the photo has been sent, NeighborPlay is no longer responsible for the toys.
Please ensure your porch or drop-off area is secure. If toys are lost, stolen, or damaged after confirmed delivery, the card on file will be charged the replacement cost of each item. An email receipt will be provided for all items purchased (or items of similar quality and value, if exact replacements are unavailable).
7. Payments & Billing Schedule
Payments are charged automatically through our secure payment processor (Stripe) based on your selected plan. Your billing date will recur monthly on the same calendar day as your initial purchase. For example, if you subscribed on May 29, your next charge will occur on June 29.
If your subscription began on a date that doesn’t exist in a future month (such as the 31st), your billing will be processed on the last valid calendar day of that month. For example, if your billing starts January 31, your February charge will occur on February 28 (or 29 in a leap year), and resume on the 31st of March. This ensures a consistent monthly billing cycle.
If your payment fails, we will retry within 48 hours. After that, your service may be paused until payment is received.
If toys are not returned by your scheduled swap date, a late fee of $1 per day, per toy or set will apply. Late fees are capped at $50 per swap cycle to keep things fair. To avoid a late feedrop off your current toys to us on or before your swap date if you’re still finalizing new selections.
8. Subscription Changes & Cancellation
You may pause, upgrade, downgrade, or cancel your subscription. Any changes must be made at least 2 days prior to your next scheduled toy delivery/swap (starts at 8AM) . Cancellations made after that window will still incur the upcoming cycle’s charge.
9. Cleanliness & Safety
We thoroughly clean and inspect all toys between uses using child-safe sanitizing practices. Please do not attempt to sanitize toys using bleach or harsh chemicals, as this may damage them.
10. Liability
By subscribing to our service, you acknowledge and agree that NeighborPlay Toy Exchange is not responsible or liable for any injury, harm, or death resulting from the use or misuse of any borrowed toys or equipment. It is the parent or guardian’s sole responsibility to:
Select toys that are appropriate for their child’s age, abilities, and developmental stage
Closely supervise children during play at all times
Inspect toys before and during use to ensure safe play conditions
Our toys are intended for use under responsible adult supervision. You accept full responsibility for the safe use of all products in your care.
